“FBI Faces Lawsuit Over Missing Property: A Closer Look”




In a recent news development, two individuals, Don Mellein and Jeni Pearsons, have taken legal action against the FBI, claiming that their property went missing following an FBI raid on U.S. Private Vaults, a Beverly Hills-based company. The case sheds light on issues related to civil forfeiture and the accountability of law enforcement agencies.


Background of the Case

Don Mellein, a retired civil servant, had stashed away cash and valuable gold coins worth hundreds of thousands of dollars in his safety deposit box at U.S. Private Vaults. Jeni Pearsons and her husband had also chosen to rent a security deposit box to safeguard their assets. Notably, neither Mellein nor Pearsons had been charged with any crime when the FBI seized their belongings.


After the FBI seized their property, both Mellein and Pearsons received notices indicating that the FBI intended to keep their assets through a process known as civil forfeiture. Pearsons found this process disingenuous and shrouded in opacity, prompting her to team up with the Institute for Justice to fight for the return of her property. Mellein, however, hired an attorney and spent a substantial sum, around $40,000, to reclaim his items.


The Missing Property Dilemma

The crux of the issue revolves around the missing property. When both individuals went to claim their property from the FBI, they were met with an unpleasant surprise — some of their items were nowhere to be found. Mellein was given the cash from his box, but disappointingly, none of his 110 gold coins were in the inventory.


Even more concerning was the FBI’s lack of records regarding the missing coins, as they weren’t listed on the property receipt. According to the Institute for Justice, the FBI had initially planned to film the inventory process but abandoned this idea, choosing instead to complete inventory paperwork.


The rush to process a massive amount of seized property — nearly $86 million worth — during the FBI raid led to what was described as a “hectic” and “frenzied” search, with agents looking for cash and items to forfeit. This haste resulted in generic inventory listings such as “miscellaneous coins” or “miscellaneous items,” which offered little help to the intended purpose of safeguarding owners’ property.







Legal Battles and Disappointment

Mellein and Pearsons have faced numerous legal challenges and hurdles to reclaim their property. While they ultimately prevailed in court, the FBI’s lack of accountability and transparency was glaring. In Mellein’s case, the government found and returned 47 of his coins months later but insisted that he must dismiss his lawsuit and file a claim with the FBI to track down the remaining 63.


In March 2023, the FBI informed Mellein that it had investigated itself and found no evidence of wrongdoing or carelessness. This outcome was understandably disappointing for Mellein, who felt that the FBI had no reason to go through his box and had been careless in losing his savings.


Similarly, when Pearsons attempted to claim her property in 2021, she realized that $2,000 in cash from her box was missing. The lack of communication from law enforcement added to her frustration.


The Broader Implications

The Mellein and Pearsons cases highlight significant issues in the realm of civil forfeiture, a process that has faced criticism for its lack of transparency and accountability. The lack of recourse for property owners when their belongings go missing during such processes is a matter of concern.


The Institute for Justice, which is supporting these lawsuits, not only aims to recover Mellein and Pearson’s property but also seeks to provide victims of civil forfeiture with the means to challenge agencies when property disappears.

Both Mellein and Pearson expressed their disappointment with how law enforcement handled their cases, underscoring the need for greater transparency and accountability in such situations. It’s a stark reminder that even government agencies must be held accountable when it comes to safeguarding citizens’ property rights.
