Wrongfully Deported, Now Indicted: The Controversial Case of Kilmar Abrego Garcia
In a case that’s raising serious questions about due process and immigration enforcement, Kilmar Abrego Garcia—a Salvadoran immigrant who lived in Maryland—has been returned to the U.S. to face federal charges, after being mistakenly deported earlier this year.
Garcia was deported in March 2025, despite a 2019 court ruling that granted him protection from removal. The deportation, carried out under the Trump administration, was later deemed “wholly illegal” by a federal judge. The U.S. Supreme Court ordered his return after ruling that his deportation violated federal and international law. Garcia reportedly faced persecution in El Salvador, which formed the basis of his earlier protected status.
Now back on U.S. soil, Garcia has been indicted on two counts: conspiracy to transport undocumented migrants and the unlawful transportation of undocumented individuals. The indictment alleges that from 2016 to 2025, Garcia helped facilitate the illegal entry of migrants from countries like El Salvador, Ecuador, and Honduras into the United States. Authorities claim he used social media to coordinate movements and supplied fabricated cover stories to evade law enforcement.
